The officer considered the key issues to be the design of the door itself, its impact on the character and streetscene, and neighbouring amenities.
General Policy 2
General Policy 2 requires development to respect local character, protect amenities, and avoid unacceptable impacts. The officer tested the door against sub-clauses (b) (c) (g) (k), finding no adverse effects on character, streetscene, or neighbouring amenities due to low visibility, minimal overlooking beyond existing levels, and the unremarkable rear area context. No tensions noted as all aspects complied fully.
no objection
Manx Petroleums Limited objects to the retrospective installation of a garage door due to boundary infringement, inaccurate drawings, structural issues, and non-compliance with design guides and building regulations.
Key concern: door opens outwards across boundary into private car park, obstructing parking and breaching Residential Design Guide 7.1.3
Manx Petroleums Limited
Objectionneither Manx Petroleums nor our tenant were consulted by Mr Fromm before, or during, the door installation; Residential Design Guide (July 2021), Item 7.1.3 states: 'It should also be noted that, whilst the Department does not involve itself in ownership issues between neighbours (as these are a civil matter), applicants should ensure that no part of the extension (including foundations and guttering) crosses the boundary line.'; The door installed is not fire rated and therefore contravenes current Building Regulations, posing a possible risk to users of the car park.; We appeal to the Officers and Committee to not condone the applicant's deliberate actions in ignoring the Planning process
