I refer to the application 19/00510/CON by Mrs Anna Kawalek in Application for the deregistration of the former Groudie Glen Hotel (19/00287/REGBLD) in accordance with 7(1)(a) of the (Registered Buildings) Regulations 2013.
The Department has determined to REFUSE the application and in doing so has given you interested party status. A copy of the Officer's report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department, Murray House or via Government online services by using this link https://services.gov.im/planningapplication/services/planning/search.iom.
The decision constitutes retention of the said property on the Protected Buildings Register for the following reasons:
(1) No works may be executed (a) for the demolition of a Registered Building, or (b) for its alteration or extension in any way which would affect its character as a building of special architectural or historic interest without grant of formal Registered Building Consent
NOTE: Following assessment of the application, taking into account the reasons put forward and considering these against the statutory requirements and the Operational Policy it is concluded that the information provided in the application is not sufficient to warrant deregistration of the building which is of architectural and historic interest.
Sections 14 to 16 of the Town and Country Planning Act 1999 impose special controls on the demolition, alteration and extension of registered buildings. As this property has been retained on the Register, those controls will continue to apply.
The effect of this refusal is that the property remains on the Protected Buildings Register.
Should you wish to appeal against this decision your request must be in accordance with paragraph 11 of the Regulations, specifically, in writing, signed by you as appellant, and submitted to the Department within 21 days of the date of this Notice.
