This application is for a Certificate of Lawful Development in respect of certain historic works carried out at 31 Derby Road Douglas.
It has arisen following queries raised by advocates on behalf of an intended purchaser of the property, the property being a single dwelling house.
The queries relate to planning and/or building control approvals had been obtained in relation to certain specified works on the property, these are
1) PVC replacement windows 2) Installation of rooflights 3) Alteration of roof eaves with PVC fascia boards 4) Creation of second floor bathroom 5) Parking area to the rear yard
A check has been made on the Planning website and no applications for these works have been identified. In correspondence with the Planning Department it has been determined that the bathroom works, item 4, do not require Planning approval as it is not classed as development, the other items would have required approval.
As all items were carried out and completed more than 4 years ago, the last one being some seven and a half years ago in August 2011, we now make an application for a Certificate of Lawful Development in respect of items 1), 2), 3), and 5) namely
The installation of PVC replacement windows in the property, The installation of rooflights in the property, The alteration of the roof eaves with PVC fascia boards on the property and The parking area in the rear yard.
The details of each of these are as below and supported by an affidavit from our client with supporting letters/invoices from the contractors involved.
The installation of PVC replacement windows in the property.
In the affidavit of our client and the accompanying letter from Douglas Glazing Ltd it is shown that the windows were installed in 2004 on the Derby Road (front) elevation and in 2010 on the rear elevation. Further proof of this is contained in the attached extract from Google Earth showing the Derby Road façade in September 2010 and accompanying photographs of the façade for comparison taken in December 2017.

The Google Earth image shows that the windows have been installed in the property for more than 7 years, this is in excess of the 4 year requirement for their certification as lawful development
In the affidavit from our client and the accompanying letter from Douglas Glazing Ltd it is shown that the rooflights were installed at the same time as the windows installations. The attached extract from Google Earth showing the Derby Road façade in September 2010 shows the rooflights on this elevation.

The affidavit from our client shows that this work was carried out in July and August 2011 and is supported by the accompanying invoice dated 3 August 2011, and noted as paid on 4 August 2011, from the contractor R. Nelson.
This work was executed some seven and a half years ago, this is in excess of the 4 year requirement for its certification as lawful development
This has existed for some time, alterations were made in 1997 by widening the access by removal of a section of wall as noted in the affidavit from our client and the accompanying letter from their builder E. Richmond. Further proof of this is contained in the attached extract from Google Earth viewing down the lane in September 2010 and accompanying photographs for comparison taken in December 2017.

All works have existed for more than the required period of 4 years, in relation to operations carried out, for the granting of a Certificate of Lawful Use or Lawful Development
