In accordance with section 12 of the above Regulations, the person appointed by the Council of Ministers to consider this application has submitted his report.
In accordance with paragraph 12(5) (a) and (b), a copy of the appointed persons report is enclosed.
On the 28th July 2011, and after consultation, the Council of Ministers accepted the recommendation contained within that report and the application was refused for the reasons specified below.

Reasons For Refusal:
The proposed advertisement sign would unacceptably affect the visual appearance of the area and would have an adverse affect on pedestrian safety, and therefore express consent is refused.
Notes
This refusal is without prejudice to the applicant either seeking “express” consent or being granted “deemed” consent at a future date following the Department of Infrastructure’s review outlined in the note below.
The Council of Ministers directed the Department of Infrastructure to progress, as a matter of urgency, a review of the relevant legislation and regulatory provisions, particularly the control of Advertisement Regulations 2005, to establish further clarity on the circumstances under which “deemed consent” would be granted for “A” boards and other such means of advertisements, without precluding the potential for “express consent” on a case by case basis in some circumstances.
