TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Registered Buildings) Regulations 2013

In pursuance of powers granted under the above Act, and subordinate Orders and Regulations, the Department of Environment, Food and Agriculture determined to REFUSE an application by Kelman Ltd., Ref 22/00148/CON, for the Registered buildings consent for the demolition of the Registered Buildings No's 27 - 28 North Quay and Demolition of No's 22, 23, 25 and 26 North Quay which are buildings within a Conservation Area. at 22 - 28 North Quay Douglas Isle Of Man IM1 4LE for the following reason(s):

• 1. The demolition the registered building 27-28 North Quay is unacceptable as the application does not demonstrate that all reasonable efforts have been made to preserve the building have been made or a sufficient justification for its total loss. As such, the unnecessary loss of the building would fail to preserve the building, its setting and features of special architectural and historic interest and is contrary to SP4, GP2, EP 30, 31 and 32 of the Isle of Man Strategic Plan 2016, RB/3, RB/6 of Planning Policy Statement 1/01 Policy and Guidance Notes for the Conservation of the Historic Environment of the Isle of Man, Area Plan for the East 2020; and Our Island Plan 2022.
• 2. The loss of the registered building situated within the North Quay Conservation Area is unacceptable as the application has failed to demonstrate reasonable effort has been made to retain the structures or provide sufficient justification for their loss and would fail to preserve or enhance the character and appearance of the North Quay Conservation Area and is contrary to SP4, GP2, EP35 and 39 of the Isle of Man Strategic Plan 2016, CA/2, CA/6 of Planning Policy Statement 1/01 Policy and Guidance Notes for the Conservation of the Historic Environment of the Isle of Man, Area Plan for the East 2020; and Our Island Plan 2022.

Guidance Note

This decision was made by the Planning Committee in accordance with the authority delegated to it.

This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

A copy of the Officer’s report and any correspondence which led to the assessment and decision is available to view on the Government’s website (via Online Services www.gov.im/Viewapplications) or at the Department’s offices Murray House, Mount Havelock, Douglas.

Appeal Any appeal must be in writing and submitted to the Department within 21 days of the date of this Notice. The appeal must contain:

the grounds for making the appeal;

payment of the planning appeal fee (currently £305); and if relevant, confirmation that the appellant wishes to have the appeal determined by means of an inquiry and payment of the additional inquiry fee (currently £115).

Failure to meet all of the relevant above requirements will mean that the appeal cannot be validated.

If this decision becomes final because there is no appeal, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House. Please note that if the counter copy of the application is not collected within thirty days following the last date on which a planning appeal can be made it will be destroyed without further notice.
