Delegated Condition Approval Report

Item For Delegated Consideration TO: Jennifer Chance, Development Control Manager FROM: Jamie Leadbeater, Assistant Planning Officer DATE: 30th July 2012 Re: PA 12/00037/B – Subdivision of existing dwelling into two dwellings, Kerrowchord, Greeba. The Development Control Manager is requested to consider submissions made in relation to condition numbers 4 and 5 of the above approved planning application that was resolved at appeal. Condition no. 4 states: "Prior to occupation of either of the two proposed dwellings, a scaled plan shall be submitted to and approved in writing by the Planning Authority indicating the allocation of two parking spaces for each dwelling and which shall be retained for such purposes in perpetuity unless a change is otherwise agreed in writing by the Planning Authority". The applicant has submitted a scaled parking scheme for each recently approved dwelling, which identifies 1 parking space at the front of each dwelling and 1 dedicated off-site parking space within the existing garden area on the opposite side of the A1 highway. Furthermore, the proposal plan for alterations to the existing garden wall also illustrates that 6 metres of the existing garden wall will be removed to create the vehicular access for the two off-site parking spaces, one for each dwelling. As such, given the clarity of the submissions in respect of the above condition, it considered the proposals would comply with the condition. Condition no. 5 states: "Prior to commencement of any work in respect of the approved development, a scheme for the demolition and re-building of the existing Manx stone wall along the A1 garden boundary shall be submitted to and approved in writing by the Planning Authority. The submitted scheme shall include details of the materials to be used for the re-built wall and the timescale for demolition and re-building operations". The applicant has submitted three detailed scaled drawings in respect of the requirements detailed in Condition 5. A 1:200 scale drawing illustrates the position of the existing Manx stone wall that bounds the A1, and also illustrates the position of the re-built wall. A 1:100 scale 'wall profile' drawing illustrates the height of the re-built stone wall and timber palisade fencing behind it. A 1:50 scale cross-section drawing illustrating the difference between the existing wall's height and width, compared to the proposed re-built wall and fencing combination. The applicant has stated the proposals have been developed following discussion with Jim Davidson in the Highways Division. The applicant has also submitted a written statement indicating the methodical steps to be taken to carry out the works until completed, and proposes a timescale of four weeks be agreed with the Planning Authority in order to complete the works. In respect of the requirements set out in Condition 5, it is considered the applicant has submitted all required details. The main objective of Condition 5 was to improve visibility at the Ballachurry Road junction, given the proximity of the two off-site parking spaces to the junction. It is considered the proposed height and position of the re-built wall and fencing should achieve such a desired effect. Although the proposed fencing would materially alter the appearance of the street-scene, it will enable privacy to be retained within the garden area and also help improve visibility, which are considered to be of greater overriding importance in the case of the application and ensure the condition is adhered to. Furthermore, it is considered the written statement clearly outlines the process for visibility improvement operations and details the scale and appearance of the proposed new boundary wall. As such, it is considered the applicant has complied with the condition in this respect. The proposed timescale of 4 weeks to complete the works from once approval of the scheme is granted, is shorter than normally expected, but illustrates the applicant's desire to complete the works within the quickest time a possible, and therefore is considered acceptable.
