1.0 THE APPLICATION SITE - 1.1 The application site is part of the highway area to the front of 20A Duke Street, Douglas, which is within ownership of the Department of Infrastructure. The property 20A Duke Street is currently used as "The Eatery" which is a café.
2.0 THE PROPOSAL - 2.1 Full planning approval is sought for the installation of signage on the posts and banners which are proposed under 16/00542/B, around a proposed external seating area which fronts 20A Duke Street. The post-and-rail banners are proposed to separate the area from the highway. The new area would be 2.4m x 1.8m, including the access to the unit. Around this proposed seating area are proposed steel post to be 0.9m-high steel with black fabric panels between, the panels have advertising on them with the word "The Eatery" in white with a green background.
3.0 PLANNING HISTORY - 3.1 The application site has been the subject of the following planning application which is considered to have material relevance to the determination of the current planning application: - 3.2 Creation of an outside seating area - 16/00542/B- PENDING CONSIDERATION
4.0 PLANNING POLICY - 4.1 The site is within a wider area zoned for Shopping uses on Map No.1 (Central Area) of the Douglas Local Plan Order (1998); no Written Statement accompanies the Douglas Local Plan. The site is not within a Conservation Area. - 4.2 Due to the zoning of the site and the proposed works the following policies are relevant in the determination of the application:- - 4.3 General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

4.4 General Policy 6 states: "Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:
4.5 General Policy 7 states: "Within our towns and villages, the display of external advertisements on sites or buildings other than those to which they relate will not generally be permitted."
5.0 REPRESENTATIONS - 5.1 No comments received.
6.0 ASSESSMENT - 6.1 The key issue to take account of is the potential impact upon the visual amenities of the street scene. - 6.2 The signage is considered to be simple in form and layout and of appropriate quality in terms of materials and finish. As a result, it is considered to have an acceptable impact upon the visual amenities of the street scene. The proposal is therefore considered to comply with general Policies 2, 5 & 7.
7.0 RECOMMENDATION - 7.1 It is recommended that the application is approved.
8.0 PARTY STATUS - 8.1 By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons:

With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.
