Officer’s Report THE SITE
1.1 The site is the residential curtilage of an existing dwelling which is relatively recently completed and situated at the western end of Close Famman, a cul de sac which leads from Ballafesson Road to the east to the Cherry Orchard aparthotel to the west. The house is one of two built in recent years on land which was left over from the development of Close Famman and the land between Station Road and the aparthotel (see Planning History). The land alongside Station Road, to the rear of this application site, was developed as apartments whereas the two plots on Close Famman were developed as individual dormer bungalows. - 1.2 The dwelling on the site is a dormer bungalow with two dormers in the front pitch and a single one in the rear. The plans show four parking spaces to the front of the property although the approved scheme, PA 14/00633/B shows the western half of the front garden given to a lawn. - 1.3 The dwelling has four bedrooms, a kitchen, lounge, dining area and toilet and bathroom facilities. THE PROPOSAL
2.1 Proposed is the use of the property for holiday accommodation as well as permanent residential use. No changes are proposed to the dwelling. PLANNING POLICY - 3.1 The site lies within an area designated on the Area Plan for the South adopted in 2013 as Residential. The land immediately to the west is designated as Tourism and the Cherry Orchard is referred to as one of the hotels in the south which should remain as such (Tourism Proposal 1).
3.2 The Strategic Plan contains the following policy and advice which are considered relevant to the consideration of the application:
Paragraph 9.5.8 states, "The use of existing private residential properties as tourist accommodation may be acceptable if it can be demonstrated that it will not compromise the amenities of any neighbouring residents."
Business Policy 13 states: "Permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents".
4.1 The dwelling was approved under PA 14/00633/B with a number of previous applications having been approved for the principle of development and the detail of development for this and the adjacent plot. REPRESENTATIONS - 5.1 Department of Infrastructure Highway Services indicate that there is no highway interest in the application (24.06.16) and Port Erin Commissioners support the application (13.07.16). ASSESSMENT - 6.1 Many properties on the Island are being proposed for the dual use of residential and tourist accommodation, the majority of which are approved. Those few on which there have been issues relate to potential detrimental impact on neighbours through comings and goings and unfamiliarity with services such as refuse collection, which may result in noise or nuisance. However, the vast majority of this sort of application has been approved, in accordance with the Strategic Plan policy and guidance.
6.2 In this case the property is situated at the end of a cul de sac and immediately alongside an aparthotel which has a predominantly tourism use. Port Erin has many facilities which are attractive to tourists - the railway station and line, the beach, the many public houses and cafes as well as a number of hotels, self catering accommodation and guest houses. As such, the proposed dwelling is considered to be well sited in relation to all of these and appropriate for an additional use for tourist accommodation. - 6.3 Being at the end of the cul de sac, it is not considered that the tourist use of the property would result in any adverse impact on the living conditions of those in surrounding properties and as such the application is recommended for approval.
7.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons:
With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.

C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.
Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
This decision relates to drawings received on 13th June, 2016.
