General Policy 3

Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Removal if not for agriculture
The agricultural building hereby approved shall be removed and the ground restored to its former condition in the event that it is no longer used or required for agricultural purposes. Reason: The building has been exceptionally approved solely to meet agricultural need and its subsequent retention would result in an unwarranted intrusion in the countryside.
Agricultural use only
The building must be used only for agricultural purposes. REASON: the countryside is protected from development and an exception is being made on the basis of agricultural need. As such the building must be used for the purposes for which it is approved.
Remove storage container
The storage container outlined on approved plan 02 as shall be removed within 28 days of the substantial completion of the building hereby approved. Reason: The storage container is in place without planning approval and its removal would be in the interest of protecting the visual amenity of the area.
Materials - colour
The external walls on the new barn must be a dark green/olive green colour and the external roof finish must be a laurel green/ dark green/olive green colour all being retained thereafter. Reason: In the interests of the character and appearance of the site and surrounding area.
Landscaping scheme
No development shall take place until full details of soft landscaping works have been submitted to and approved in writing by the Department and these works shall be carried out as approved. Details of the soft landscaping works include details of new planting above the existing banking along the eastern field boundary (approximately taken from the position of the existing shipping container to the corner of the field adjacent to the dwelling Ballamoar). All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the building, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species. Reason: To ensure the provision of an appropriate landscape setting to the development.
