In accordance with paragraph 10 of the above Order, the person appointed by the Council of Ministers to consider this application has submitted his report. In accordance with paragraph 10.3(a) and (b), a copy of the appointed persons report is enclosed.
On the 23rd February 2012, and after consultation, the Council of Ministers accepted the recommendation contained within that report and the application was refused for the reasons specified below.

Reasons For Refusal:
After consideration the Council of Ministers agreed with the Inspector's recommendation to refuse the application for planning approval for the reasons specified in his report.
NOTE Council noted that post inquiry correspondence had been submitted to the Chief Secretary's Office by Mr Cannan MHK, addressed to the Inspector. Following consideration Council agreed that the matters raised by Mr Cannan in his correspondence did not add any new evidence to that which could have been raised at the Inquiry and agreed to disregard the letter.
