Kelly landowners object due to breach of deed requiring a 4ft stock-proof fence and inadequate drainage solution; Drainage Division defers pending engineered drainage solution to prevent wall foundation undermining.
Key concern: Breach of deed condition for 4ft stock-proof fence and drainage undermining wall foundations
Kelly landowners (Michael S. Kelly and Alan E. Kelly on behalf of six joint owners)
Objectiona condition was that the Commissioners erect and maintain ‘a stock proof fence not less than four feet in height’; the proposed boundary structure not meet the height requirement; severe reservations that it will be stock proof; potentially causing serious flooding behind the wall. A more permanent and satisfactory solution needs to be found for this outfall
Isle of Man Water and Sewerage Authority Drainage Division
Conditional No Objectionthe Authority are unhappy with the drainage proposal and have asked for an engineered solution; as the application stands the surface water disposal would undermine the foundations of the wall. Defer please until a solution is proposed and accepted by the Authority
Conditions requested: Defer until an engineered solution is proposed and accepted by the Authority
