1.0 Description
1.1 Planning Application 24/91042/B was APPROVED on 10.12.2025 for:
Construction of 1no industrial unit to form a covered operational waste transfer station, including fencing alteration
1.2 This approval is subject to 4 conditions, some of which require the submission of additional information prior to the commencement of works.
1.3 This report is specific to conditions No. 4, which the applicants are seeking to satisfy. The specific wording of the condition is as follows:
No development may be commenced nor any equipment, machinery or materials be brought onto the site for the purposes of the development until a tree protection plan which provides details of a Construction Exclusion Zone ('CEZ'), and suitable protective fencing for the adjacent trees has been submitted to and approved in writing by the Department.
Within the CEZ nothing shall be stored, placed or disposed of above or below ground, the ground level shall not be altered, no excavations shall be made, no mixing of cement or use of other contaminating materials or substances shall take place, nor shall any fires be lit.
The implemented CEZ may only be removed when the construction work has been fully completed on the site.
Reason: to ensure that all trees to be retained are adequately protected from damage to health and stability throughout the construction period to protect and enhance the appearance and character of the site and locality.
2.0 Proposal
2.1 The applicant's agent has submitted an application form on 18.11.2025 along with:
- location plan
- tree protection statement
- tree protection plan
3.0 Consultation
3.1 DEFA Forestry for the approved application was consulted for advice. Their advice was received on 16.01.2026. They concluded that, after reviewing the submitted documents, this submission satisfy the relevant clauses.
4.0 Recommendation
4.1 In this instance of the submitted documents and after consultation with DEFA Forestry, which is happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning conditions 4 of application 24/91042/B, under the understanding that the development shall not be carried out unless in accordance with the approved details.
I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status.
