General Policy 2
Requires developments to respect site surroundings (b), not adversely affect residential amenity or locality character (g), provide satisfactory parking and access (h), and not harm road safety or traffic (i). The officer assessed the proposal as compliant subject to conditions on hours, staff, and use restrictions, as client visits would be minimal and similar to domestic activity, with Highways support.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
Operating hours
The beauty/nail treatment use, hereby approved, shall only be open for use by clients/customers, between the hours of 0730 and 2000 Monday to Friday, and 0800 and 1200 on Saturdays. No customers shall be allowed onsite outside of these hours or at any time on Sundays or Bank holidays. Reason: In the interests of the amenity of neighbouring residents in accordance with General Policy 2, parts g, h & i of the Isle of Man Strategic Plan 2016.
No additional staff
The beauty/nail treatment use, hereby approved, is for the sole use by the occupant of the dwelling; therefore no additional staff, other than the occupant, shall be employed as part of the business operating from the application site. Reason: To prevent an increase in on-street parking demand in the interests of highway safety and amenity in accordance with General Policy 2, parts g, h & i of the Isle of Man Strategic Plan 2016.
Restricted use of lounge
Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2012 (or any Order revoking and/or re-enacting that Order with or without modification) the lounge shall only be used as a Class 1 beauty/nail treatment or for purposes incidental to the residential use of the dwelling and shall not be used for any other purpose within Class 1. Reason: To ensure proper control of the development and to avoid any future undesirable uses being carried out on the site in the interest of the amenity of the neighbouring properties in accordance with General Policy 2, parts g, h & i of the Isle of Man Strategic Plan 2016.
