Refusal Decision Notice
Town and Country Planning Act 1999
Town and Country (Development Procedure) Order 2005
Miss Catherine Audrey Corrin Scravorley Curragh Road St Johns IM4 3LN
In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby REFUSE the following application made on behalf of:
Name: Miss Catherine Audrey Corrin Proposal: Material alteration of field access, creation of a hard standing and access drive and change of use of land to residential (Retrospective) at: Field 315982 Scravorley Curragh Road St Johns Isle Of Man
which was considered on 26th July 2011, for the reasons set out below. Date of Issue: 27th July 2011 Murray House Mount Havelock Douglas
Mrs C Dudley Deputy Secretary to the Planning Committee
Reason(S) For Refusal:
- Whilst the motives for constructing an access and hardstanding area to serve the property Scravorley are understood, the proposed access does not provide adequate visibility in either direction and as such would be prejudicial to highway safety contrary to Transport Policy 4 of the Strategic Plan.
- Whilst not proposed by this application, the creation of the vehicular access would require substantial alteration to the boundary bank and the removal of several mature trees. This would be harmful to the character of the surrounding area contrary to Environment Policy 1 of the Strategic Plan.
This decision was made by the Director of Planning and Building Control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
