Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, Environment Policy 39
Douglas Corporation has no objection to the proposal.
The occupier of No.33 Ballaquark has provided the following comments: 1) I have no idea why this small, tatty basic, miserable little building has been registered, but presumably it has some historic merit to warrant the registration. 2) However, I fail to see how its demolition and removal (and presumably redevelopment of the site)
The application is seeking Registered Building Consent for the demolition of a non-registered building in a Conservation Area. The existing garage is of timber construction. It is proposed to demolish and replace it with a purpose built garage. the garage does not have any architectural merit and is an inappropriate structure for a Conservation Area. The existing garage does not contribute to the
character and appearance of the Conservation Area. It is considered the merits of the replacement structure should be considered within this application as the structure is regarded as an inappropriate structure within a Conservation Area. It was concluded in a recent planning application (10/01327/B) for the replacement garage that the proposal cannot be regarded to preserve the character and appearance of the Conservation Area as it is replacing a timber garage; however, it was considered the proposal would be an enhancement on what currently exists. The proposed structure is similar in design a recently approved garage on the adjacent site.
It is recommended that the application be approved so as to facilitate the redevelopment of the site in accordance with the recent planning permission.
RECOMMENDATION It is recommended that Registered Building Consent be granted subject to conditions. PARTY STATUS
The local authority are, by virtue of The Registered Buildings Regulations 2005, paragraph 8 (5) (c) and (e), considered "interested persons" and as such should be afforded party status.
The occupier of No.33 Ballaquark given his distance from the application site is not granted Interested Party Status under the provisions of Planning Circular 1/06.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
This consent relates to the demolition of a timber garage as shown in drawing number WL/10/1166/1A date stamped 2 November 2010. I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer. Decision Made : Permitted
