General Policy 2
Requires development to respect site/surroundings in siting/layout/scale/design/landscaping, not adversely affect landscape character, protect habitats/trees/sod banks, safeguard amenities, and provide safe access/parking. Officer found compliance via retention of key hedges/sod banks preserving street character, minimal amenity impacts with buffering, safe highway access, and biodiversity mitigation balancing removals.
Transport Policy 1
New development should be located close to public transport/pedestrian/cycle routes. Site well-connected to pedestrian routes in Andreas with existing parking, confirmed safe by DOI.
Transport Policy 4
Highways must accommodate generated traffic/pedestrians safely. No objections from DOI; low additional traffic as use aligns with adjoining sports facilities.
Environment Policy 5 - Mitigation against damage to or loss of habitats
Protects/enhances biodiversity/environment. Retention of most vegetation, trimming rather than removal, and DEFA acceptance post-amendments ensured no significant loss.
Environment Policy 4
Protects biodiversity including habitats/species. Some hedging removal on northern/northwest boundaries for safety/visibility caused tension with DEFA initially, resolved by amendments retaining most features, trimming, and condition securing them; balanced against child safety and former play park tree retention.
Time limit
The development hereby approved shall be begun before the expiration of four years from the date of this decision notice. Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.
Retain boundary hedges/sod bank
Notwithstanding the details that have been submitted, the leylandii hedge bordering the eastern boundary of the site, the sod bank to the southern boundary of the site, and the hedge on the southwest section of the site, shall be retained as shown on the Proposed Illustrations 1 and 2, and as indicated in the Planning Statement, all received 24 August 2023. The boundary treatment shall be retained as such thereafter unless changes to the surrounding landscaping have been submitted to and approved in writing by the Department. Reason: In the interests of protecting and enhancing the biodiversity of the environment, and to safeguard the appearance of the development and the surrounding area.
No significant negative impact upon highway safety, network functionality and/or parking; do not oppose the proposals following review of revised plans.
Content with proposals after additional information; boundary vegetation mostly retained but trimmed back; request condition for retention/trimming outside nesting season.
DEFA Biodiversity initially raised concerns about shrub removal impacting biodiversity but became content after clarifications, requesting conditions for vegetation retention and trimming outside nesting season; Highway Services consistently found no significant highway impacts and did not oppose.
Key concern: removal of shrubbery detrimental to biodiversity and contrary to Strategic Policy 4 (b)
DEFA Biodiversity
ObjectionThe Ecosystem Policy Team do not believe that there is currently enough information submitted with this application.; Without this, we believe the application would be contrary to Strategic Policy 4 (b) of the Isle of Man Strategic Plan
Conditions requested: updated plan showing plans for the park in relation to the shrubbery; plan showing where replaced shrub planting is to be undertaken
DEFA Biodiversity
Conditional No ObjectionWe do not object to this application, we just think that more clarification is required.; If the boundary hedges and sod bank are to be retained then we will retract our initial comments.
Conditions requested: simple diagram show which vegetation is to be removed and which is to be retained

DEFA Biodiversity
Conditional No ObjectionI’m content with what is being proposed, as it doesn’t involve the total removal of boundary vegetation, just its trimming back.; We would, as always, ask that boundary trimming is undertaken outside of the nesting bird season (March - August inclusive).
Conditions requested: boundary trimming is undertaken outside of the nesting bird season (March - August inclusive); a condition is secured for boundary hedging and the sod bank to be retained but trimmed back in line with the visuals provided
